These Terms of Service ("Terms") are an agreement between you and Zabiry LLC ("Zabiry", "we", "us"), a North Carolina limited liability company that operates the Zabiry customer ordering website and the Zabiry mobile apps for iOS and Android (together, the "Service"), and govern your use of the Service to browse participating halal restaurants, butchers, food trucks, and cafés and place orders for pickup or, where available, delivery. The apps and the website provide the same ordering service, and references to "the site" in these Terms apply equally to the apps. By placing an order or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Zabiry provides the online ordering technology that lets independent halal restaurants, butchers, food trucks, cafés, and bakeries accept pickup and delivery orders. The shop you order from is the seller and is solely responsible for the food, including its preparation, pricing, availability, and fulfillment. Zabiry is a technology provider and is not the seller of, and does not prepare, the food.
You must be at least 18 years old (or the age of majority where you live) to place an order. You can order with a Zabiry account — signing up with an email and password, or signing in with Google or Apple — or check out as a guest. If you check out as a guest, we create a guest record to hold that order; you cannot sign in to it, and you can turn it into a full account right after ordering by setting a password. You are responsible for keeping your login credentials secure and for activity under your account. You can view your order history, update your profile, manage saved payment methods, and delete your account at any time from your account settings.
When you submit an order you are making an offer to purchase from the shop you selected. An order is accepted when the shop confirms it or begins preparing it. You are responsible for providing accurate contact details and for reviewing your order before submitting it.
Prices are set by the shop and shown before you check out. Sales tax is calculated automatically based on the items in your order and the tax rules that apply where the shop is located — neither the shop nor Zabiry sets the tax rate — and where Zabiry acts as a marketplace facilitator, we collect and remit it. Zabiry adds a processing fee that covers the cost of processing your payment; it is shown at checkout, together with sales tax, on the “Taxes & Fees” line before you pay. For items sold by weight, the price shown is an estimate based on the amount you request: your card is authorized for the estimated total, and the final amount is charged based on the actual weight once your order is prepared. By placing the order you authorize this final charge. You will not be charged more than the actual weight plus any fees disclosed at checkout. If you choose delivery where it is available, a delivery fee and any optional driver tip are also shown before checkout and included in your total; the driver tip goes to whoever delivers your order, as described in Pickup and Delivery below.
Payments are processed by a third-party, PCI-compliant payment processor. You can pay with a credit or debit card or, where offered, with a digital wallet such as Apple Pay or Google Pay; a wallet payment is processed like any card payment and is also subject to the wallet provider's terms. By placing an order you authorize the hold (authorization) and the final charge (capture) described above. Zabiry does not store your full card number. You may choose to save a card to your account for faster checkout; saved cards are held securely by our payment processor in tokenized form, and you can remove a saved card at any time from your account. Your use of payment features is also subject to the processor's terms. In the mobile apps, if your device has Face ID, Touch ID, or fingerprint unlock enrolled, we ask the device to confirm it is you before showing your saved cards or deleting your account. Your device performs that check and tells us only whether it succeeded — Zabiry never receives or stores your fingerprint, face, or any other biometric data. This check is on by default, and you can turn it off for that device in your account's Device Lock setting. If your device has no biometric unlock enrolled, this step is skipped.
Orders are available for pickup at the shop you select and, where a shop offers it, for delivery to an address you provide. For pickup, please collect your order during the shop's hours and within a reasonable time after it is marked ready; each shop may set its own policy for orders that are not picked up. Delivery is carried out in one of two ways, and which one applies is shown at checkout: by an independent third-party delivery provider (currently Uber) arranged through the site, or by the shop itself using its own staff or drivers. Zabiry is not the carrier and does not deliver orders in either case. When you choose delivery you must provide a complete, accurate delivery address and any access instructions; the delivery fee and any optional driver tip are shown before you check out. Where a shop delivers its own orders, the delivery fee and any tip go to that shop; where a third-party courier delivers, the tip goes to the courier. Delivery is available only where the shop delivers to your address or a courier can be arranged for it; if neither is available, you are not charged a delivery fee and may choose pickup instead. Delivery times are estimates and are not guaranteed. You are responsible for being able to receive the order at the address you provide, and if you ask that it be left unattended (for example, at the door), you accept the risk of doing so.
Cancellations, refunds, substitutions, and other order issues are handled by the shop that prepared your order, according to its policies and applicable law. Please contact the shop directly with any concern about your order. Zabiry does not control and is not responsible for a shop's refund decisions. In limited cases — for example to correct a billing error or to resolve a payment dispute — Zabiry may issue a refund itself; it is returned to you in the same way as any other refund. A shop can cancel and refund a whole order, or refund one or more individual items from an order it has already prepared. Any refund is issued to the original payment method you paid with — we cannot send it anywhere else — and typically appears within about 3 to 5 business days, although the exact timing is determined by your bank or card issuer and is outside our control. When an item is refunded, the tax and the processing fee charged on that item are refunded along with it. If your order is cancelled before any money is taken, the authorization hold on your card is released instead, and no charge is made. We will email you when a refund is issued and, if you receive text messages about your order, also text you a link to a receipt showing what was returned.
The shop is solely responsible for the quality, safety, ingredients, allergen information, and halal status of the food it sells. Product photos are provided by the shop and are illustrative; the item you receive may vary. If you have allergies, dietary restrictions, or questions about how food is sourced or prepared, please contact the shop before ordering. Zabiry does not independently verify these matters.
We send transactional messages about your orders — such as confirmations and status updates — by email; these are a necessary part of completing your order. If you turn on push notifications, we may also send order updates, occasional reminders about items you left in your cart, and occasional announcements or offers from Zabiry. You can turn push notifications off at any time in your device settings. Most of the emails we send are transactional messages about your orders and your account, which are a necessary part of your order and account. We may also send promotional or marketing emails from time to time; when we do, each one includes an unsubscribe link you can use at any time, and unsubscribing from those will not affect the essential order and account emails. By providing a phone number when an order is placed — including a phone (call-in) order you place with a shop — you consent to receive calls or text messages about that order at that number. These are transactional order messages, not marketing; message frequency varies with your order (usually a few messages per order), message and data rates may apply, and you can reply STOP to opt out at any time. We will not send you marketing texts on this basis.
You agree to use the site only for lawful purposes, and not to place fraudulent orders, misuse a payment method, interfere with the site's operation, or attempt to gain unauthorized access. We may refuse or cancel orders we reasonably believe are fraudulent or abusive.
The site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Zabiry and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to your use of the site will not exceed the amount of the order giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.
These Terms, and any dispute arising out of or relating to them or your use of the site, are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You and Zabiry LLC agree that any such dispute will be resolved exclusively in the state or federal courts located in Guilford County, North Carolina, and you consent to the personal jurisdiction of those courts. This does not affect any rights you may have under the mandatory consumer-protection laws of the place where you live. Issues specific to a particular order — such as refunds, substitutions, or food quality — are handled by the shop that prepared it, as described above.
We may update these Terms from time to time. Changes take effect when posted, with a new effective date. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
